According to the investigation, Ihor Marnianskyi, director of Ladobud LLC, deliberately overstated the cost of construction works performed for the State Institution O.O. Shalimov National Institute of Surgery and Transplantology of the National Academy of Medical Sciences of Ukraine.
An audit of financial and economic activity for the period of 2011–2014 established that, in the certificates of completed works drawn up by Ladobud LLC, the cost of direct expenses was overstated by over UAH 1 million. This concerned the cost of materials, products, and structures actually incurred by the subcontracting organizations. The director of Ladobud LLC signed the certificates of completed works, entering knowingly false information about the cost of materials and works into them. As a result, the O.O. Shalimov National Institute of Surgery and Transplantology of the NAMS of Ukraine was caused material damage in the amount of UAH 1 million.
The indictment in this criminal proceeding was drawn up by an investigator of the Solomianskyi Police Department of the Main Directorate of the National Police in Kyiv. The pre-trial investigation was not conducted by the NABU, nor was it completed by SAPO prosecutors. Information about the criminal offense had been entered into the Unified Register of Pre-Trial Investigations before the Law of Ukraine on the operation of the High Anti-Corruption Court entered into force.
Therefore, in the opinion of the participants in the proceedings, the case had been sent to the HACC by mistake. The court then referred this question to the HACC Appeals Chamber. The panel concluded that the proceedings did not fall within the HACC's jurisdiction and were subject to consideration by the Solomianskyi District Court of Kyiv.
