Case description

On April 16, 2024, the HACC found former MP Maksym Poliakov guilty of unjustified receipt of compensation for renting a hotel room. Based on the plea agreement, the court replaced the sentence for 3 years of probation. 

According to the investigation, from December 1, 2016, Maksym Poliakov lived in his own apartment, but decided to receive additional compensation from the budget. In January 2018, he signed two statements to the Verkhovna Rada Office, and based on them, he received over UAH 367,000 by August 2019. 

Poliakov pleaded guilty and concluded an agreement with the SAPO prosecutor. His actions are qualified under Article 364(2) of the Criminal Code of Ukraine. Based on the plea agreement, the court released the former MP from serving the main sentence of 3 years in prison, imposing a 3-year probationary period and an additional fine of UAH 17,000 with a ban on holding certain positions for a year.

Poliakov was previously accused of false declaration: detectives found an undeclared apartment worth almost UAH 11 million, more than UAH 5 million in income and UAH 5 million in expenses for the purchase of an apartment in his 2016-2017 declarations. 

However, in October 2020, the Constitutional Court issued a scandalous judgment abolishing criminal liability for false declarations. Therefore, the HACC closed the case against Poliakov in this part. In addition, Poliakov, along with former MP Borys Rosenblat, is a defendant in the “amber” case. They allegedly demanded USD 300,000 for amber extraction.
