Case description
On October 13, 2022, the HACC found Olena Netyshenska, former deputy director of the State Enterprise Information Center of the Ministry of Justice, guilty of signing fictitious contracts with the former director and causing more than UAH 7 million in losses to the enterprise. She got a suspended sentence.
Between January 2014 and February 2015, Leonid Bohdanov, the head of the State EnterpriseInformation Center of the Ministry of Justice, and his deputies Bezpalko and Netyshenska organized the conclusion of agreements for the supply of software for territorial justice and enforcement services. Namely, they ordered a computer program for video conferencing called TrueConf from the private company Asten-MN.
In fact, the services under these agreements were not provided, and the defendants knew about it. However, Netyshenska, who had been acting as the CEO of the state enterprise since October 2014, continued to sign the necessary documents to implement the criminal scheme. The funds paid were later legalized and transferred to foreign companies, and the State Enterprise suffered more than UAH 7 million in losses.
The court qualified Netyshenska's actions under Article 364, part 2, of the Criminal Code of Ukraine. She made a deal with the prosecutor and got a 5-year suspended sentence with a 2-year probationary period. Additionally, she was fined UAH 17,000 and banned from holding certain positions for 2 years.
