Today, the HACC Appeals Chamber reviewed the verdict in a case involving abuse of office in connection with the leasing of Boryspil Airport property outside of competitive tender procedures and at below-market rates.
In March 2023 the HACC found the airport's former director and the head of its lease relations department guilty of abuse of office and aiding and abetting such abuse under Article 364(2) of the Criminal Code. The charges related to the transfer of state property for lease without a competitive process and at an understated value.
The Appeals Chamber reduced the sentence of former Boryspil Airport Director Yevhenii Dykhne from five to four years of imprisonment, and that of airport department head Olesia Levochko from four to three years. In addition, the convicted parties are jointly required to pay over 1.33 million hryvnias in material damages to the State Property Fund, as well as to reimburse the state's procedural costs.
The ban on holding certain positions (three years) and the fine imposed by the court of first instance remain in place.
The Appeals Chamber's verdict takes effect from the moment it is pronounced, meaning the convicted parties must begin serving their sentences. At the same time, the law preserves their right to lodge a cassation appeal with the Supreme Court.
