HACC Sends Kachnyi Case to Trial After Rejecting Plea Agreement

The High Anti-Corruption Court has sent to trial the criminal case against MP Oleksandr Kachnyi, who is charged with illicit enrichment.

Both parties asked the court to schedule the case for trial. The prosecutor said the pre-trial investigation had been completed in full and that the flaws the court had identified in the agreement were not critical and could be remedied later. The defense lawyer argued that the terms of the first agreement fully complied with the law and that, from day one, the defense had sought to cooperate with the investigation and reach an agreement.

Since the parties are procedurally entitled to submit a revised agreement after the case is scheduled for trial, the judge issued a ruling to continue the proceedings.

The parties then addressed matters of trial preparation, including an open hearing format, the order for examining evidence and questioning witnesses, the absence of grounds to close the case or return the indictment, and the fact that no new agreement has been reached so far. The HACC ruled to proceed to trial. The next hearing is scheduled for October 16 at 10:00 a.m.

In September 2026 the SAPO sent the HACC an indictment with a plea agreement. Kachnyi fully admitted his guilt of illicit enrichment totaling UAH 12.7 million. He suffers from a serious illness and requires treatment, and he also has to pay off medical debts. Under the terms of the agreement, Kachnyi also consented to the special confiscation of UAH 12.98 million and agreed to transfer an additional UAH 3 million to support the Defense Forces of Ukraine.

However, the HACC judge refused to approve the agreement with Kachnyi, citing, among other things, the court’s concerns about the method of transferring the funds and the confiscation of property belonging to a third party.
