The HACC granted the motion of former head of the NEURC, Oksana Kryvenko, a defendant in the Rotterdam+ case, to be released from criminal liability due to the expiration of the statute of limitations. The proceedings against her were closed, while the civil claim against her was left without consideration.
Kryvenko had been accused of official negligence related to the application of the “Rotterdam+” formula.
Since more than five years have passed since the alleged offence, the statute of limitations has indeed expired. However, it should be noted that closing a case on these grounds does not have an exonerating effect.
