On May 13, 2026, the HACC Appeals Chamber considered the defense's appeals against the April 21 ruling ordering the in absentia pre-trial detention of former Presidential Office Deputy Head Rostyslav Shurma.

The panel denied the appeals and left the investigating judge's ruling unchanged.

Shurma is abroad and subject to an international wanted notice. In July 2025 — six months before the suspicion notice was served — the NABU conducted searches at his residence in a Munich suburb, after which he relocated to Austria.

Shurma remains active on social media and has commented on the case, calling it politically motivated and stating his readiness to cooperate with the investigation. He shows no apparent intention of returning to Ukraine, however. 

“As of today, my permanent place of residence is the Federal Republic of Germany, which the pre-trial investigation authority is aware of. For this reason, I have repeatedly submitted official requests to ensure my participation in procedural actions in the manner prescribed by law — via video conference or on the premises of Ukrainian diplomatic missions abroad,” Shurma wrote.

According to the investigation, in 2019–2020 Rostyslav Shurma and his brother Oleh took control of a number of electricity-generating enterprises in the Vasylivka district of Zaporizhzhia Region, built solar power plants there, and entered into contracts with the state enterprise Guaranteed Buyer to sell electricity under the green tariff. After Russia's full-scale invasion, the plants ended up under occupation and lost connection to Ukraine's energy grid. Despite this, the scheme's participants continued to declare electricity production and collect green tariff payments. Total losses to the state amount to UAH 141.3 million.
