Case description
On November 22, 2021, the HACC found Vasylkiv officials Taras Borys and Nataliia Tychyna guilty of promising to change the intended purpose of land plots for a bribe of USD 47,000. Both got 5-years suspended sentences with additional punishment.
In 2016, Taras Borys, acting head of the Architecture and Urban Planning Department of the Vasylkiv District State Administration, together with Nataliia Tychyna, acting director of ME Architectural Bureau of the Vasylkiv District Council, promised a local to change the intended purpose of land plots in exchange for a bribe.
Borys, in collusion with Tychyna, received EUR 34,500 through intermediaries, and together they incited the resident to transfer another USD 13,000 to officials of the Kyiv Regional State Administration. The last tranche, however, was not received as Borys and Tychyna were detained.
The actions of Borys were classified under Article 368, part 3; Article 27, part 4; Article 15, part 2; Article 369, part 3; Article 15, part 2; Article 190, part 3 of the Criminal Code of Ukraine. That is, taking a bribe, promising to pass on a bribe to other officials, and fraud. Nataliia Tychyna's actions were classified in a similar way — under Article 27, part 5; Article 368, part 3; Article 27 part 4; Article 15, part 2; Article 369, part 3; Article 15, part 2; Article 190, part 3 of the Criminal Code of Ukraine.
However, the court closed a part of the criminal proceedings against officials for abuse of influence (Article 369-2 of the Criminal Code), as the statute of limitations had expired.
Both Borys and Tychyna concluded plea agreements, so they were sentenced to 5-year suspended sentences with a 3-year probationary period. Additionally, Borys was banned from holding certain positions for 3 years, and his accomplice was banned from holding certain positions for a year.
