According to the investigation, Valerii Kondratenko, head of the Directorate of the State Committee for Land Resources in Ivankiv District, knowingly approved the transfer into private ownership of land belonging to the Strakholissia Village Council that formed part of the water fund and forest fund lands. He acted in the interests of third parties and abused his official position.
As a result, 42 citizens received ownership of land plots with a total area of 83.99 hectares, drawn from the reserve land of the Strakholissia Village Council of Ivankiv District. In reality, however, these plots belonged to the water fund and forest fund lands and were not subject to transfer into private hands.
The HACC applied to the HACC Appeals Chamber to have the criminal proceedings transferred to another court, since they had been entered in the URPI in 2016, before the law on the HACC took effect, and the pretrial investigation had been conducted by the police and the prosecutor's office rather than by the NABU and the SAPO.
The panel concluded that the proceedings did not fall within the HACC's jurisdiction and were to be transferred for hearing to the Ivankiv District Court of Kyiv Region.
