According to the investigation, Yevhen Yehorov, director of the Pushcha-Vodytsia Recreation Complex, facilitated the unlawful construction of a private residential house and auxiliary structures on the territory of the Pushcha-Vodytsia recreational area in Kyiv.

In particular, abusing his official position, he did not prevent the unauthorized seizure of a land plot or the unlawful construction on it. He also facilitated the registration and legalization of the resulting real estate, acting contrary to the requirements of land, environmental, and construction legislation. The area of the unlawfully occupied land plot exceeds 1 hectare, and its seizure caused the state losses of over UAH 1.2 million.

Initially, the defendant's counsel filed a motion to change the jurisdiction, since the indictment in these proceedings had been drawn up by an investigator of the Main Investigation Directorate of the Prosecutor General's Office of Ukraine, and before the entry into force of the law establishing which cases fall within the High Anti-Corruption Court's jurisdiction. On that basis, the defense argued that the proceedings were not subject to consideration by the HACC.

In that earlier motion, however, the defense did not provide proper evidence to substantiate these arguments, so the court denied the motion to change the jurisdiction. Subsequently, after the position was further clarified, the panel of judges accepted defense counsel's arguments and concluded that the proceedings did not fall within the HACC's jurisdiction and were to be transferred to the Obolonskyi District Court of Kyiv.
