Case description

On February 3, 2022, the HACC found Oleksii Mytrokhin and Liudmyla Shashkova, the former heads of grain procurement state-owned enterprises, guilty of attempted abuse of authority that could have led to million-worth embezzlement. They got suspended sentences.

In 2011–2017, when the criminal scheme was functioning, Mytrokhin headed Boroshno Pokrovske LLC, and Shashkova headed State Enterprise Bread Base No. 85.

They were involved in a large criminal proceeding with as many as 9 suspects. The defendants collaborated to create artificial debts for two state-owned enterprises, one of which was the State Enterprise Bread Base No. 85 and to withdraw the proceeds of crime to the accounts of controlled companies.

Among the six recorded criminal episodes, there is one in which the defendants deprived the state-owned enterprise of its trademark for nothing, although according to experts, it was worth about UAH 20 million. Shashkova and Mytrokhin did not have time to do any real damage, as the UAH 75 million in debts they created in 2015–2016 were not collected. The court took into account that they acted under the instructions of the then-head of one of the state enterprises involved in the scheme.

Mytrokhin's actions as an accomplice were qualified under Article 27, part 5; Article 15, part 2 and Article 364, part 2 of the Criminal Code of Ukraine, and Shashkova was charged with Article 15, part 2 and Article 364, part 2 of the Criminal Code. The ex-officials have concluded plea agreements. 

In the end, the HACC found them guilty of attempted abuse of office and sentenced them to 4 years in prison, but exempted them from punishment with a probationary period of 3 years. The defendants were also sentenced to additional punishment: a fine of UAH 34,000 and a ban on holding certain positions for 3 years.
