Case description
On March 7, 2024, the HACC found Viacheslav Danshyn guilty of complicity with a judge of the Kropyvnytskyi Court of Appeal in taking a bribe. He was sentenced to 3 years of probation on the basis of a plea agreement.
In the spring of 2023, the Kropyvnytskyi Court of Appeal considered an appeal against the verdict of the Dobrovelychkivskyi District Court, whereby the perpetrator of a fatal car accident was sentenced to 3 years in prison.
According to Danshyn, the presiding judge, Volodymyr Honchar, initially asked for USD 3,000 for a suspended sentence, while the intermediary himself asked for USD 350. The judge set a condition that the victim of the accident had no claims against the perpetrator of the accident.
Later, because the victim did not withdraw his claims, the judge reduced the amount of the unlawful advantage to USD 1,500. For this amount, the judge promised to reduce the sentence from 3 years to 1.5 years in prison. In addition, Danshyn asked for USD 500 for intermediary services. However, the perpetrator was dissatisfied with such conditions.
After a while, the perpetrator offered Judge Honchar a bribe of USD 10,000 through Danshyn. The intermediary accomplice also received USD 500 and had to keep the entire amount of the bribe until the appellate decision.
The actions of the intermediary Danshyn were qualified under Article 368, part 3 of the Criminal Code of Ukraine. He concluded a plea agreement, therefore, the court imposed a 3-year probationary period with a prohibition on holding public offices for one year. Danshyn also pledged to donate UAH 50,000 to the needs of the Armed Forces of Ukraine.
