On December 3, 2024, the HACC AC upheld the decision to confiscate the assets of SBI official Andrii Chapchai and his wife, prosecutor Yulia Apolonina.
In July 2024, the HACC recognized the following assets as unjustified:
-
Apartments in the residential complex French Quarter 2 (UAH 3.8 million), registered in the name of the prosecutor's grandmother.
-
Parking spaces (UAH 700,000), registered in the name of the prosecutor's aunt.
-
Partially, apartments in Kyiv, registered in the name of the aunt (UAH 2.5 million recovered).
The HACC requested to recognize all assets as unjustified and confiscate them, including the garden house. According to the prosecutor, the court incorrectly established the date of the start of its construction.
Regarding other property, the court agreed that part of the money for the apartment, registered to the aunt, was paid from Chapchai's official income. So, part of its value was recovered. The garden house was built with legally obtained funds.
The prosecution claims that the real difference between the value of the spouses' property and their legal income is UAH 7.12 million.
At the same time, the defense requested that the decision of the HACC be overturned altogether. In their opinion, recognizing assets as unjustified can only apply to property acquired after November 28, 2019—the date of entry into force of the law on confiscation of unjustified assets.
The defense also argued that the spouses worked all this time and were able to save money, and all their income was legal. In addition, the panel of judges of the HACC allegedly incorrectly established the method and date of acquisition of the apartments.
