On October 21, 2026, the HACC partially granted the defense’s motion and reduced bail for former Supreme Court judge Oleksandr Prokopenko from UAH 900,000 to UAH 500,000.

The defense argued that the suspicion was unfounded. Counsel also said the risks to the criminal proceedings identified by the investigating judge had run their course and no longer existed. The defense therefore asked for the preventive measure to be revoked entirely.

The prosecutor asked the court to deny the motion. He noted that an investigating judge had recently dismissed a complaint against the notice of suspicion, so the question of whether the suspicion was well-founded had already been settled. He also stressed that all the risks were still present.

According to the investigation, Grand Chamber judge Zhanna Yelenina, Supreme Court judges Iryna Hryhorieva and Ihor Zhelieznyi, and retired Supreme Court judge Oleksandr Prokopenko accepted unlawful benefits in exchange for ruling in the interests of Finance and Credit Group owner Kostiantyn Zhevaho. The businessman is accused of bribing Vsevolod Kniaziev.
