The panel of judges of the HACC Appeals Chamber dismissed the prosecutor’s appeal against the investigating judge’s ruling, which reduced the bail for the Head of the AMCU, Pavlo Kyrylenko, from UAH 30 million to UAH 25 million. The ruling remains unchanged.
The SAPO prosecutor requested that the ruling be overturned, arguing that some of the grounds considered by the investigating judge should not have influenced the decision to alter the interim measure. The key factor in question is the financial obligations of the bail provider, Keramet LLC, which approached the defense team asking them to request the modification.
The amount of UAH 25 million represents just over one-third of the assets Kyrylenko is accused of acquiring illegally. The prosecutor believes that such a bail amount is insufficient to ensure that the suspect complies with his procedural obligations and to mitigate the risks involved.
The defense requested that the appeals proceedings be closed or that the appeal be dismissed.
The defense lawyer stated that the prosecutor is distorting the circumstances, noting that the bail remains significant and other restrictions are in place. He also pointed out that the prosecutor had previously appealed changes to the obligations imposed on Kyrylenko and that she appeals any ruling she disagrees with, regardless of whether it is subject to appeal or not.
The NABU and SAPO recently notified Kyrylenko of a new suspicion for failure to declare assets, and his wife was charged with aiding and abetting illicit enrichment. In addition, since August 2024, Kyrylenko has been suspected of illicit enrichment in excess of UAH 72 million. The pre-trial investigation in that case was completed in December 2024. The HACC has set a deadline of July 4, 2025, for the defense to review the case materials, after which the indictment will be submitted to the court.
