On April 9, 2025, the HACC decided to end the preparatory session and proceed with the consideration of the merits of the Rotterdam+ case. Preparation for the trial lasted more than two years, as the case was submitted to the court in March 2023.

The case will be tried by a single HACC judge, with the hearing scheduled for April 18 at 11:00 AM.

The first preparatory session in this case took place in March 2023. Then the case was terminated based on Lozovyi's amendments. However, the HACC AC canceled the termination. Later, two episodes were consolidated, and another preparatory session was scheduled for January 2024. Finally, today, it was decided to proceed with the consideration of the merits.

The Rotterdam+ case involves 14 defendants. Two of them, Volodymyr Butovskyi and Dmytro Vovk, are being tried under a special procedure. The hearing was repeatedly postponed due to the defendants' failure to appear.

According to preliminary estimates, the statute of limitations for the first episode expires in 2027. By that time, the HACC must manage to consider the case, and the HACC AC must reconsider the final judgment.

As we previously reported, according to the investigation, from 2016 to 2019, a formula was used that included the cost of coal transportation from Rotterdam ports for TPPs, although this transportation did not actually occur. As a result, consumers overpaid, and DTEK received superprofits. The total losses are estimated at more than UAH 38 billion.
