Today the HACC Appeals Chamber was unable to consider the motion by MP Yuliia Tymoshenko's defense counsel to change the jurisdiction of the criminal proceedings — the defense is seeking to have the case transferred from the HACC to the Kyiv Court of Appeal.
Tymoshenko filed a motion to adjourn, citing official trips to France from June 19 to 24 and to Austria from June 27 to July 2.
The defense stated that Tymoshenko wishes to personally argue the grounds for transferring the case to another court, and therefore asked for the hearing to be deferred until her return.
The prosecutor opposed the adjournment, seeing no legal grounds for it. He noted that the trips were fully funded by the Batkivshchyna faction, which Tymoshenko leads, and are entirely her political party's initiative. In his opinion, prioritizing official travel over a court hearing is not appropriate.
The panel granted the defendant's motion and adjourned. The hearing on the motion is rescheduled for July 3 at 11:30.
