According to the investigation, former Talne mayor Oleksandr Bilenko, in collusion with Anatolii Shutka and Hennadii Bezchasnyi, unlawfully transferred the State Enterprise Talne Grain Processing Plant into the private ownership of regional council member and businessman Oleksandr Korotkov.
They allegedly organized the unlawful conversion of the enterprise's state-owned property (which was not subject to privatization) into private ownership, using false and forged documents. This made it possible to include the property complex in the liquidation estate and sell it at auction.
The pretrial investigation in these criminal proceedings was conducted by the Investigation Directorate of the Cherkasy Regional Main Directorate of the National Police, under the procedural guidance of the Cherkasy Regional Prosecutor's Office, rather than by the NABU and the SAPO. Yet under the law, proceedings entered in the URPI before September 22, 2019, may be transferred to the HACC only in cases investigated by NABU and completed by SAPO prosecutors.
The defense counsel and the prosecutor therefore filed motions to change the jurisdiction. The HACC then referred the question to the HACC Appeals Chamber. The panel concluded that the proceedings did not fall within the HACC's jurisdiction and were to be heard by the Talne District Court of Cherkasy Region.
