Case description
On March 5, 2021, the HACC found engineer Oleksandr Dzhembri guilty as an accomplice in the case of damages to the Berdiansk port. Based on the agreement, he was given a suspended sentence of 3 years in prison with a fine of UAH 8,500 and deprivation of the right to hold certain positions for 1 year 6 months.
Oleksandr Dzhembri is a former engineer of the Berdiansk branch of the Ukrainian Sea Ports Authority. In 2018, he, together with the head of the branch Oleksandr Barchan, his deputy Vitalii Burian, and the ex-director of a private enterprise Natalia Panchenko, arranged a corruption scheme.
It was about Berdiansk port transferring almost UAH 2.5 mln to a company for the actually undelivered equipment. Before that, the organizers of the scheme had conducted a tender on Prozorro and had awarded Kharkiv ElektroSudenMontazh, despite the fact that the bid did not meet all the requirements of the tender.
Dzhembri himself, as an engineer, deliberately drew up documents about a truck crane with false data, allegedly, the crane was delivered, but with malfunctions. As a result of the scheme, the state suffered almost UAH 2.5 mln in losses.
Engineer Dzhembri's crime was qualified under Article 28, part 2 of the Criminal Code of Ukraine and Article 364, part 2 of the Criminal Code of Ukraine. He concluded a plea agreement, so the punishment imposed was UAH 8,500 of a fine with deprivation of the right to hold certain positions for 1 year 6 months. Dzhembri was released from the main sentence (3 years in prison) with a probationary period of 2 years.
