Case description
The HACC found former director of West Prite LLC Oleksandr Radko guilty of aiding the commission of a crime by removing obstacles to the misappropriation of real estate belonging to the state-owned enterprise National Cinematheque of Ukraine.
According to the investigation, between 2016 and 2019, the organizers of the criminal scheme developed a plan under the guise of rehabilitating the financially distressed NCU. The aim was to acquire its assets at an artificially low value. Officials from the Ministry of Culture and the NCU were involved in implementing this plan. They approved an unlawful rehabilitation plan and ensured that a preselected company won the auction, acquiring the buildings at a significantly understated price. The case concerns 14 buildings and structures on the outskirts of Kyiv, valued at approximately UAH 42 million.

As an accomplice, Radko acquired a share in the authorized capital of West Prite LLC to use it in the auction for the sale of NCU property. He ensured West Prite LLC’s participation in the auction and the conclusion of the sale and purchase agreement for NCU’s real estate.
The HACC approved a plea agreement with Radko and charged him under Article 364(2) of the Criminal Code of Ukraine. He was sentenced to a four-year suspended imprisonment with a three-year probation period, a ban on holding certain positions, and a fine. Under the terms of the agreement, he disclosed one of the organizers and transferred a bail amount of UAH 10 million to the Come Back Alive Foundation.
A total of eight individuals are involved in this case, including former Deputy Minister of Culture Tamara Mazar, former Ministry of Culture officials Yakubivskyi and Babych. The HACC has already convicted several individuals: organizer Labenskyi, perpetrators Stanilevych and Banduryst, and accomplices Radko and Shulhan.
