The NABU and the SAPO charge Pavlo Kyryliuk, acting deputy CEO of the Kyivpastrans Municipal Enterprise, and Yurii Kurbal, former director of the Directorate for the Construction and Maintenance of Transport Facilities and Auxiliary Infrastructure, with the embezzlement and misappropriation of budget funds during the implementation of projects to reconstruct and repair transport infrastructure facilities.

According to the investigation, during the performance of a works contract between the Kyivpastrans Municipal Enterprise and Enerhospetsremont LLC, a scheme was carried out using false information in documents. This concerns the misappropriation of city budget funds allocated for the design of the reconstruction of the tram line at the railway station.

In the prosecution's view, Kyryliuk and Kurbal arranged for the preparation, drawing up, and use of official documents containing false data about the actual performance of the work under the contract.

The investigation established that the municipal enterprise's officials secured the victory of a controlled contracting organization in the tender by creating artificial competitive advantages. To circumvent the requirement for certified specialists, forged expert signatures were used, which became the grounds for the subsequent conclusion of the relevant contract.

The Kyivpastrans officials then, aware that the submitted documents were false and non-compliant, signed the acceptance certificates. In this way, they created the appearance that the work had been properly performed, although this was not the case.

Also involved in the case is Oksana Prokopenko, director of the Eltrans private enterprise. According to the investigation, she secured her company's victory in the tender by submitting false data about the availability of qualified personnel. For example, the documents listed engineers who did not actually work at the company. In addition, instead of developing new design documentation, old materials were used that the Kyivpastrans Municipal Enterprise had already paid for earlier.

As a result of this scheme, according to the investigation, the Kyivpastrans Municipal Enterprise sustained material losses of around UAH 13 million.

The defendants' actions were classified under Article 366(2) and Article 191(5) of the Criminal Code of Ukraine. The trial is currently ongoing.

The HACC had earlier approved a plea agreement with Oksana Prokopenko. As punishment, the court sentenced her to eight years' imprisonment, with a three-year ban on holding administrative and economic positions. Pursuant to Article 75 of the Criminal Code, she was released from the custodial sentence on two years' probation. The defendant was released from punishment for forgery in office owing to the expiry of the statute of limitations.

According to the investigation, the Kyivpastrans officials, in collusion with representatives of contracting organizations, organized a scheme under which they arranged for budget funds to be transferred for services that were not in fact provided, thereby causing the enterprise losses of around UAH 13 million.
