Oleksii Sukhachov, the director of the State Bureau of Investigation, dismissed Andrii Chapchai after the HACC's decision to confiscate the illegally acquired assets of the official and his family came into force. However, on February 12, Sukhachov reinstated Chapchai to his post by his own order.
How is this possible? The provisions of Ukraine's Corruption Prevention Law state that an official against whom such a court decision has entered into force is subject to dismissal. However, the law on the State Bureau of Investigation does not prohibit the reappointment of such a person to a position, which, in fact, occurred in Chapchai's case.
The same law specifies that individuals who possess the personal, professional, and moral qualities necessary to effectively perform their duties can serve in the Bureau. The State Bureau of Investigation, in particular, handles corruption cases not investigated by NABU. The question arises whether Chapchai meets these requirements.
Chapchai is currently appealing the confiscation decision before the Supreme Court. He and his wife, prosecutor Yuliia Apolonina, had their apartment in the French Quarter 2 residential complex in Kyiv, along with a parking space and other assets, confiscated.
