The NABU and the SAPO accuse the former director of the state enterprise Broadcasting, Radiocommunications and Television Concern (BRT), Kostiantyn Zakharenko; the former head of the sector for control over the use of state property at BRT, Volodymyr Stashchuk; and the head of Liga-Expert LLC, Volodymyr Honchar, of embezzling around UAH 1 million from the enterprise.

According to the prosecution, in order to embezzle funds, BRT officials concluded contracts for the development of technical land management documentation for land plots that were either not in BRT's use at all or only partially so.

The essence of the scheme was to order land management work and the production of technical documentation for land plots to which BRT had no proper rights or for which it had no real need. In the process, certificates of completed works were drawn up to create an appearance of legality and to justify the expenses. To make their actions look lawful, the members of the group used their official powers and drew up knowingly false official documents, in particular work acceptance and transfer certificates.

In particular, Zakharenko signed a contract with Liga-Expert LLC, knowing full well that the Concern had no rights to this land. Until 2003, its lawful user had been the Kyiv Radio Transmitting Center SE, but it was liquidated without any legal successors at all. The right of use therefore ceased and did not pass to BRT.

The money was transferred even despite the absence of permits from the authorities and numerous violations in the content of the documentation. In addition, at the same time the contractor was preparing documents for these same plots of land for private individuals — employees of the Concern and their relatives.

The next episode concerned a plot in Kyiv. Officials of the Concern ordered the development of documentation, even though similar work had already been carried out earlier by another firm and accepted by the Concern. Instead of a full-fledged project, Liga-Expert LLC prepared only a “technical report,” which had no legal force for registering rights, yet received full payment for it.

The third episode covered land with a total area of 804.3 hectares in Mykolaiv Region. Despite the fact that an inventory of these plots had already been carried out in 2011, the participants in the scheme concluded a new contract worth more than UAH 610,000. When the powers of the Concern's head expired, the director of Liga-Expert LLC, Honchar, in order to still carry out the planned embezzlement, initiated a lawsuit to recover the debt — this made it possible to forcibly withdraw funds from the state enterprise's accounts, including inflation losses and the court fee.

As a result of these coordinated actions, the investigation believes, the individuals in the case caused the Concern damage totaling UAH 976,100.

Their actions were classified under Article 191(5) and Article 366(1) of the Criminal Code of Ukraine.

The HACC found them guilty. Zakharenko was sentenced to 7.6 years' imprisonment with confiscation of property. Stashchuk and Honchar were each sentenced to 7 years' imprisonment with confiscation of property. They were also deprived of the right to hold certain positions for 3 years.

At the same time, the individuals in the case were released from serving the sentence under Article 366(1) of the Criminal Code of Ukraine due to the expiry of the limitation period.
