Businessman Serhii Bairak was found guilty in the case of former SPFU Head Dmytro Sennychenko. The scheme participants are suspected of misappropriating over UAH 500 million from the Odesa Portside Plant and the United Mining and Chemical Company.

According to the prosecution, the former SPFU Head, together with others, was involved in the misappropriation of more than UAH 500 million in 2019–2021. The first episode concerns the Odesa Portside Plant, which lost more than UAH 390 million as a result of fraudulent schemes from May to December 2020.

The actions of Serhii Bairak, one of the participants in the alleged scheme, are qualified under Article 364(2) of the Criminal Code.

As reported by UNN, Bairak is a co-owner of Chili Group LLC and PDBS Group LLC. Bairak was previously a top manager for Firtash. Among other things, UA-MEDIA LLC, the former sales house of Firtash’s InterMediaGroup, is registered in his name.

The HACC approved the plea agreement between Serhii Bairak and the SAPO prosecutor and sentenced him to 5 years of imprisonment, suspended, with a fine of UAH 8,500. The court set a probationary period of 1 year and imposed on the defendant the obligations provided for in Article 76 of the Criminal Code.
