Case description
The HACC acquitted Oleh Halushko, former head of the Main Apartment and Maintenance Department of the Armed Forces of Ukraine. He was accused of embezzling over UAH 20 million within the purchase of apartments for the Ministry of Defense.
According to the prosecution, Halushko's plan was to artificially inflate the marginal cost of a square meter of housing in Kharkiv. Apartments were bought on the secondary market, and sales contracts were concluded in the interests of companies.
In the course of 2018, based on purchase and sale agreements concluded between the Ministry of Defense and a private company, funds were paid for real estate, of which UAH 21.5 million, according to the investigation, was unjustified.
The official's actions were qualified under Art. 191, part 5 of the Criminal Code of Ukraine. However, the Supreme Court acquitted Halushko. The panel of judges decided that his actions did not constitute a crime.
