Case description
On June 7, 2021, the HACC delivered a guilty verdict against Oleksandr Skoryk, the former acting chair of the board of PJSC Kyiv-Dnipro Intersectoral Enterprise of Industrial Railway Transport. He deliberately entered into insurance contracts that were unfavorable for the company, causing the state to suffer UAH 8.8 million in losses.
PJSC Kyiv-Dnipro Intersectoral Enterprise of Industrial Railway Transport is engaged in the transportation of goods by rail. It is a joint-stock company fully controlled by the state. Accordingly, its insurance costs must be planned and approved in the financial plan for the respective year and should not exceed 1.5% of net profit.
In 2016, when the events in this case took place, the company's financial plan did not include any such expenses. Nevertheless, Skoryk, as acting chair of the board, promoted the decision to conclude these contracts, and later the railroad company transferred UAH 8.8 million to the insurance company Lemma City Server. This amount was several dozen times higher than the maximum allowable, and the services under the contracts were not actually provided.
Skoryk's actions were classified under Article 364, part 2 of the Criminal Code of Ukraine. He was sentenced to 4 years in prison with a fine of UAH 17,000 and deprivation of the right to hold certain positions for a year.
The appellate instance later ordered Skoryk to pay UAH 8.8 million in damages to the state. The Supreme Court only upheld Skoryk's sentence.
