Case description

On March 24, 2023, the HACC found MP Anna Kolisnyk guilty of false declaration, for “forgetting” to indicate property worth UAH 4.4 million in her 2020 declaration. The proceedings against her were closed because the statute of limitations had expired.

MP Anna Kolisnyk submitted an e-declaration to the NACP for 2020, in which she failed to indicate a number of details worth UAH 4.4 million. In particular: two apartments in Kyiv, a share of non-residential premises in Kharkiv, and a Cadillac car she used.

 

In court, Kolisnyk explained her actions as follows: she had allegedly alienated the warehouse premises earlier, had not used the car for a long time, and had simply forgotten about the apartments in Kyiv. The MP later corrected the errors in her declaration.

The statute of limitations for prosecution under the article incriminated to Kolisnyk, namely Article 366-2, part 1 of the Criminal Code of Ukraine, is only 2 years. In view of this, the MP repeatedly missed court hearings, and the court even fined her UAH 2,684 for this.

Once, the defense counsel argued that Kolisnyk was forced to urgently go to Lebedyn, Sumy region, because of her mother's illness. She was unable to join the meeting from there because of an alleged power outage, although, according to Ukrenergo, there was no power outage in the city that day.

The HACC found her guilty and fined her UAH 44,000 with a one-year deprivation of the right to hold certain positions. However, the statute of limitations had expired a week before the verdict, so Kolisnyk was exempted from punishment. However, the defense counsel was not satisfied with this.

They filed a complaint, and the appellate court closed the criminal proceedings against Kolisnyk, also because the time limit had expired.

The MP had attracted media attention even earlier, in March 2021. At that moment, journalists photographed the MP's correspondence, in which she wrote: “Listening to Khomchak. We need to get out of this country.”

Khomchak stated that Russian troops were building up near the borders of Ukraine. However, Kolisnyk stated on social media that she was not going to "get out," but simply meant a vacation for the May holidays.
