Case description
On May 7, 2020, the HACC found Roman Tymkiv, ex-director of the Lviv Armored Fighting Vehicle Plant, guilty of declaring false information and fined him UAH 51,000. This verdict was later overturned due to the scandalous decision of the Constitutional Court of Ukraine, which abolished criminal liability for false declaration or intentional failure to submit a declaration.
Tymkiv admitted his guilt in the fact that in the declaration for 2017-2018, he did not indicate that he used an apartment for more than EUR 380,000, owned by his wife, and the fact of owning the Aventa Investment Limited company, registered in the offshore zone — Belize.
The crime was qualified under Art. 366-1 of the Criminal Code of Ukraine. The court approved the agreement between the accused and the prosecutor and fined the ex-MP UAH 51,000, depriving him of the right to hold certain positions for three years.
However, on October 27, 2020, Article 366-1 of the Criminal Code of Ukraine was declared unconstitutional, so on October 30, 2020, Tymkiv's lawyer asked the HACC to review the verdict. The court reviewed its decision, overturned Tymkiv's verdict, and closed the criminal proceedings.
Interestingly, Tymkiv, together with other persons, appears as an accused in the case of embezzlement at the Lviv Armored Fighting Vehicle Plant. The plant won a tender for the supply of new engines for the Armed Forces of Ukraine; however, according to the investigation, the delivered engines were used and sold as surplus property of the Ministry of Defense in 2008-2009. Losses to the state are estimated at more than UAH 14 mln.
