Case description
On March 24, 2023, the HACC found Oleh Diadyk, Poltava Regional Council member, guilty of false declaration. Initially, he was fined UAH 34,000, but the appellate instance overturned the verdict: the statute of limitations had expired.
Oleh Diadyk entered a number of false data in his 2020 declaration. The difference between the stated and true data amounted to more than UAH 3.4 million. Specifically, Diadyk “forgot” to indicate that he owned more than UAH 2 million of the authorized capital of Meat Magnat LLC as the ultimate beneficial owner. Furthermore, almost UAH 38,000 of income received from the company and replenishment of its capital were not indicated.
Diadyk also failed to provide all the information about his bank accounts, the funds in them, his debt of almost UAH 400,000, and his obligations under a lease agreement worth UAH 800,000.
The court qualified his actions under Article 366-2, part 1 of the Criminal Code of Ukraine. Diadyk was sentenced to a UAH 34,000 fine and deprivation of the right to hold certain positions for two years. The appellate instance overturned this verdict and exempted Diadyk from punishment due to the expiration of the statute of limitations.
