Case description
On June 12, 2021, the HACC found Apollinarii Nahalevskyi, former Prosecutor General's Office official, guilty of attempting to bribe the Deputy Head of the State Audit Service.
Apollinarii Nahalevskyi worked in one of the departments of the Prosecutor General's Office of Ukraine. In 2016, the NABU launched an investigation into the alleged embezzlement of funds in the PGO when awarding contracts worth almost UAH 2 million. These contracts were checked by the State Audit Service, so Nahalevskyi decided to influence the results of the audit. From his conversations, we can understand that he called the auditors “mistresses” or “girls.
In December, Nahalevskyi transferred USD 5,000 through an intermediary who worked at the Accounting Chamber. He handed over the money to the NABU, and later the defendant asked for the money back, saying that he had not noticed any changes in the work of the auditors.
Nahalevskyi's actions were classified under Article 15, part 2 of the Criminal Code of Ukraine and Article 369, part 1 of the Criminal Code of Ukraine. The HACC sentenced him to 2 years. The appeal did not change the verdict, but released Nahalevskyi from punishment due to the expiration of the statute of limitations.
Nahalevskyi is also accused of entering into the same contracts worth UAH 1.8 million that led to the unscheduled audit by the State Audit Service. According to the investigation, these were fictitious contracts for repairs in the premises of the PGO.
The Supreme Court upheld Nahalevskyi's sentence.
