Case description
On September 27, 2022, the HACC convicted Liubov Reva, the former head of the research farm of the National Academy of Agrarian Sciences, and Maksym Zamrykot, her accomplice. They wanted to take possession of UAH 3.5 million belonging to the company by signing fictitious contracts. The HACC sentenced Reva and Zamrykot to 7 years, but the Appeals Chamber overturned this verdict, and the case is being reconsidered.
In 2016, Liubov Reva was the acting director of the state-owned enterprise Chervonyi Zemlerob (Red Farmer) Research Farm in the Kirovohrad region. Then she signed a number of fictitious contracts on behalf of the state enterprise with her accomplice Maksym Zamrykot for legal services, as well as service acceptance certificates: on their basis, the defendants planned to seize UAH 3.5 million.
After that, Reva and Zamrykot filed documents with the Kirovohrad region Commercial Court in the bankruptcy case of the state-owned enterprise. They attached a statement to include Zamrykot in the register of claims of Chervonyi Zemlerob's creditors. If successful, he could have recovered UAH 3.5 million from the state enterprise as an accomplice. However, the defendants did not succeed in seizing the funds.
The court classified Reva's actions under Article 15, part 2; Article 191, part 5; Article 366, part 1; Article 27, part 3; Article 358, part 4 of the Criminal Code of Ukraine, and Zamrykot's actions under Article 27, part 5; Article 15, part 2; Article 191, part 5; Article 27, part 5; Article 366, part 1; Article 358, part 4 of the Criminal Code of Ukraine. The defendants were sentenced to 7 years in prison with confiscation of half of their property, and Reva was additionally banned from holding certain positions for 3 years.
The appellate instance overturned the guilty verdict and ordered a new trial.
Earlier, in 2015, Liubov Reva and Maksym Zamrykot had already organized a criminal scheme to resell grain of Chervonyi Zemlerob. They gave the grain for alleged storage to a private company, which later sold it under the guise of their own harvest. As a result, the state-owned enterprise suffered losses of UAH 23 million.
