Case description
On September 9, 2024, the HACC approved the agreement and found Yevhenii Berestovyi, lawyer and Kherson district council member, guilty of bribery and fraud. Illia Lonskyi, Odesa-based judge, also appears in the case; the proceedings against him have been suspended.
According to the investigation, the lawyer incited a serviceman to give a USD 2,000 bribe to the judge for a positive decision in an administrative case. Part of the bribe was to be transferred to his accomplice—Illia Lonskyi, judge of the Prymorskyi District Court of Odesa. Law enforcement officers prevented the transfer of the bribe.
Berestovyi pleaded guilty and actively contributed to the investigation of the crime. His actions were classified under Art. 364, part 3 and Art. 190, part 2 of the Criminal Code of Ukraine. The parties agreed on a suspended 4-year sentence without confiscation of property, and effectively 2 years of probation.
Lonskyi's actions are classified under Article 369, part 3; Article 190, part 2 of the Criminal Code of Ukraine. In July 2024, the judge was mobilized. Because of this, the proceedings against him were suspended, and the materials were separated.
In addition, since August 2023, the HCJ has temporarily suspended Judge Lonskyi from administering justice.
