The NABU and the SAPO charge Oleksii Statnyk, director of the Energozbut branch of PJSC Ukrzaliznytsia, with abuses committed while he headed the Energoatom-Trading unit of Energoatom.

According to the investigation, Oleksii Statnyk — acting CEO of the Energoatom-Trading unit of SE NNEGC Energoatom — abused his official position and, acting against the enterprise's interests and the law, arranged an auction to sell electricity under bilateral agreements on the Ukrainian Energy Exchange (UEEX) on non-competitive and discriminatory terms.

The investigation established that in September 2020, Energoatom held an auction to sell electricity, in which 32 companies took part.

During the auction, more economically favorable bids from other participants — including D.Trading LLC, Poltava Mining and Processing Plant PrJSC, Le Trading Ukraine LLC, Dniprostal-Enerho LLC, and Energix LLC — were deliberately rejected, so that United Energy LLC won the bidding.

Statnyk created conditions under which the “right” company won. A contract was then signed on the basis of this auction, under which, in October–November 2020, SE NNEGC Energoatom transferred 1,465,000 MWh of electricity to United Energy LLC at UAH 1,120 per MWh (excluding VAT) — a price the investigation considers understated compared to the market.

Other participants, meanwhile, offered better prices — up to UAH 1,300 per MWh. As a result of this contract, the investigation believes, Energoatom suffered losses in the form of foregone income of UAH 93.76 million.

Statnyk's actions were classified under Article 364(2) of the Criminal Code of Ukraine. The trial is ongoing.

Oleksii Statnyk no longer holds the position of branch director. Before his appointment to Energoatom, he worked at the SSU as head of a division of the Main Directorate for Counterintelligence Protection of the Economy, and also oversaw Energoatom's work. According to public information, it was after Statnyk took charge of Energoatom-Trading that “remarkable” electricity auctions began to occur. The winners of these tenders were companies linked to Ihor Kolomoiskyi and Rinat Akhmetov. In addition, Statnyk was a pro bono adviser to former Energy Minister Herman Halushchenko.
