Case description
On June 17, 2024, the HACC found Svitlana Ancheyeva, acting head of the Legal Department of the Ovidiopol District State Administration, guilty of facilitating the seizure of state-owned land in favor of third parties. Due to the expiration of the statute of limitations, she was exempted from punishment.
According to the investigation, the Director of the Tairov Institute, his deputy, and an official of the Tairovske Research Enterprise decided to unlawfully take possession of the land that was in the use of the Institute. The plan was to transfer the land to the Tairovske RE to use and then dispose of it in their own interests.
In 2010, the aforementioned individuals asked Ancheyeva to draft and approve an order to transfer the land plots in violation of the law. As a result, land management projects were developed, according to which the land became private property, in the hands of the defendants. The state suffered UAH 16.5 million in losses.
Due to the expiration of the statute of limitations, all accomplices, except Ancheyeva, were exempted from criminal liability in 2021 and 2022. During the trial, Svitlana Ancheyeva objected to the closure of the criminal proceedings against her on the same grounds and insisted on conducting the trial in full in the general procedure and with a verdict.
Finally, in June 2024, the HACC found Ancheyeva guilty under Article 364(2) of the Criminal Code of Ukraine and sentenced her to 4 years in prison, a fine of UAH 17,000, and a ban on holding certain positions for 3 years. The defendant was released from serving her sentence due to the expiration of the statute of limitations.
