Case description
On October 9, 2024, the HACC sentenced several individuals to seven years of imprisonment for the conversion of UAH 4.3 million in public funds belonging to the Nikopol District Council.
In 2019, the Nikopol District State Administration concluded 3 contracts with entrepreneur Tetiana Hilka to procure works on inventory and regulatory monetary valuation of land. The procurement transaction was conducted under a simplified procedure, without open competitive bidding and an auction. When justifying the cost of the services provided, Tetiana Hilka referred to invalid regulations, and representatives of the Nikopol District State Administration effectively agreed to the unreasonable cost of services. In December 2019, Tetiana Hilka received UAH 4.3 million to her individual entrepreneur’s account, without any confirmation that the works had been performed.
In addition to the entrepreneur, the case involves land surveyor Viktor Selin and the first ex-deputy head of the District State Administration Hennadii Zymin. The actions of Tetiana Hilka were classified under Article 191, part 5, Article 366, part 1, and Article 209, part 1 of the Criminal Code of Ukraine, and the latter two are charged with Article 191, part 5, Article 366, part 1 of the Criminal Code of Ukraine.
The HACC sentenced all the defendants to 7 years in prison and confiscated half of their property. Hennadii Zymin was also deprived of the right to hold certain positions in public authorities for 3 years, and Tetiana Hilka and Viktor Selin will not be able to carry out activities related to the development of land management documentation for a year.
The defendants can still appeal the verdict in the appellate instance, so the verdict has not yet entered into force.
