Case description
On March 16, 2023, the HACC found Stepan Moskvych, former director of Lutsk Bread Products Plant No. 2, and Leonid Tymofiiuk, former head of the elevator of the same SE, guilty of embezzling UAH 56 million worth of grain belonging to the state.
According to the investigation, the officials embezzled 26,000 tons of grain, which PJSC Agrarian Fund (owned by the state) transferred for storage to Lutsk Breading Plant No. 2 in 2013. Moskvych, head of the company, shipped this grain to commercial entities without the appropriate permission and payment. Tymofiyuk, who was then in charge of the enterprise's elevator, helped ship the grain.
The former employees were charged under Article 191, part 5 of the Criminal Code of Ukraine. The HACC sentenced Moskvych to 10 years in prison and Tymofiyuk to 7.5 years. Moreover, all of Moskvych's property (including 50 properties, corporate rights, and a BMW X5) was confiscated, and half of his accomplice's assets were confiscated. Both defendants were deprived of the right to hold certain positions for 3 years.
