Case description
On January 21, 2022, the HACC found Mykola Kharkavyi, former Khmelnytskyi Regional Council member, guilty of inciting the acting director of a boarding school to transfer a USD 50,000 bribe to keep his job. He was sentenced to 7 years in prison, but the proceedings were suspended while Kharkavyi was undergoing military service.
Mykola Kharkavyi is a former member of the Khmelnytskyi Regional Council of the 7th convocation. In 2011–2014, he also headed the Khmelnytskyi, Lviv, Ternopil, and Vinnytsia customs offices.
Between March and June 2017, he convinced the acting director of the Kamianets-Podilskyi Slavutynka Boarding School to transfer a USD 50,000 bribe to the head and members of the Khmelnytskyi Regional Council through him to extend her contract and not to conduct any inspections at the boarding school. Kharkavyi, however, had no intention of handing over the money, but instead wanted to take possession of it. The former MP was arrested shortly after receiving the money.
The court classified Kharkavyi's actions under Article 15, part 2; Article 190, part 4 of the Criminal Code of Ukraine and Article 27, part 4; Article 15, part 2; and Article 369, part 4 of the Criminal Code of Ukraine. He was sentenced to 7 years with full confiscation of property and deprivation of the right to hold certain positions for 3 years.
