The NABU and the SAPO accuse the Deputy Head of the Slobozhanskyi District Prosecutor's Office of Dnipropetrovsk Region, Stanislav Batrak, a prosecutor of the same office, Sori Savane, and lawyer Oleksii Pedus of bringing a knowingly innocent person to criminal liability, combined with the artificial creation of prosecution evidence.

According to the investigation, the individuals involved met near the administrative building of the Slobozhanskyi District Prosecutor's Office, and during the meeting Batrak, acting outside procedure, instructed that a knowingly innocent person be selected from among the employees of Fruitberry-Dnipro LLC in order to subsequently bring them to criminal liability.

During the same conversation, investigators say, Batrak explained the mechanism for carrying out this plan, including the option of concluding a plea agreement with the application of Article 75 of the Criminal Code of Ukraine, as well as the procedure for its court approval.

Prosecutor Savane was then brought in to implement the arrangements, according to the investigation. From that point on, all procedural actions in the proceedings, including the building of the evidentiary base, were carried out by Savane.

In particular, Savane arranged for records of witness interrogations to be drawn up with predetermined testimony about the innocent person's alleged involvement in the crime. The witnesses signed these records in the presence of lawyer Pedus, even though, according to the investigation, the person had never worked at Fruitberry-Dnipro LLC and had no connection to the incriminated acts. In this way, prosecution evidence was artificially created.

In addition, the investigation alleges that Pedus initiated the production of knowingly forged documents concerning the innocent person's purported employment, including a hiring order, an employment contract, and a job description. These documents were added to the case file as evidence of his involvement in the crime.

On the basis of the collected materials, which the investigation maintains were artificially fabricated, the innocent person was served with a notice of suspicion of committing a criminal offense. Savane drew up and approved an indictment against him, knowing full well that he was not guilty. Batrak then referred the indictment to the Babushkinskyi District Court of Dnipropetrovsk for consideration on the merits.

Batrak's actions were classified under Article 190(4), Article 369(3), Article 190(3), and Article 372(2) of the Criminal Code of Ukraine; the actions of Pedus and Savane were classified under Article 372(2) of the Criminal Code of Ukraine.
