Case description
Ihor Nasalyk, the former Minister of Energy, was charged with submitting false information in his declarations for 2015-2018. On October 19, 2023, the HACC AC closed the case on the grounds that Nasalyk's actions lacked corpus delicti.
According to the investigation, Ihor Nasalyk deliberately entered false information in his declarations for 2015-2018, specifically omitting a $1.2 million loan.

The former minister was charged with Article 366-1 of the Criminal Code of Ukraine. As the result of the scandalous decision of the Constitutional Court which decriminalized false declaration, Nasalyk's case was closed in November 2020. After that, the proceedings were resumed and the court closed the proceedings several more times. In March 2023, Nasalyk's lawyer requested the revision of the decision due to exceptional circumstances. The defense believed that the court had to acquit Nasalyk since his actions lacked corpus delicti. In the end, the court refused to resume consideration of the case.
First, the HACC ruled to dismiss that request July 12, 2023 but the Appeals Chamber granted it. However, the Joint Chamber of the Supreme Court sent the case to the appellate instance for reconsideration. The most recent decision in the case was in August 2024, in which HACC AC sustained the ruling of July 12, 2023, unchanged.
In November 2017, the former Minister of Energy Ihor Nasalyk resigned. Earlier, some MPs initiated Nasalyk's dismissal because no reforms had been implemented under his leadership and the crisis in the industry even intensified.
