Case description
The HACCU convicted former State Export Control Service official Serhii Holovatyi, who had demanded USD 300,000 in bribes for permission to export dual-use goods to Russia. He was sentenced to 10.5 years in prison.
In December 2015, Holovatyi demanded that Motordetal-Konotop LLC pay him USD 300,000 for issuing a permit to export dual-use goods to Russia. The Konotop plant produced cylinder liners for internal combustion engines, the main buyer of which was a Russian plant in Kostroma. The Ukrainian company's products could be used for both tractors and military equipment, so they fell under the definition of dual-use goods.
Bribes were provided in several tranches: USD 20,000, USD 30,000, and a third tranche of USD 75,000, after which Holovatyi was detained.
Holovatyi was charged with Article 368, part 4 of the Criminal Code of Ukraine. The HACC sentenced him to 10.5 years in prison with confiscation of all property and deprivation of the rank of civil servant. He was also banned from holding certain positions for 3 years. Among the confiscated items were 2 gold bars and over USD 42,000.
Holovatyi's defense counsel filed an appeal against the court's verdict.
