Case description
On September 18, 2024, the HACC found Judge Mykola Shershak of the Zarichnyi District Court of Sumy guilty of receiving a USD 2,000 bribe. He was sentenced to 7 years in prison.
According to the prosecution, in October 2019, Judge Shershak asked for a bribe for making a decision not to bring Vitalii Shutko to administrative liability for driving under the influence. The subsequent month, the judge received money for decisions in two cases that were pending rulings. Shershak once again emphasized that in court, the accused must deny the fact of refusing to be tested for alcohol intoxication.
The HACC found Judge Shershak guilty and qualified his actions under Article 368, part 3 of the Criminal Code of Ukraine. He was sentenced to 7 years in prison with a 3-year ban on holding positions in the judiciary and confiscation of all property. Currently, Shershak still holds the position of judge and can appeal the sentence in the appellate court.
