Case description
On August 9, 2023, the HACC found Petro Makarenko and Oleh Tkachenko, directors of associations, guilty of attempting to illegally seize state land in the Kyiv region. Based on the agreement, they got suspended sentences.
In 2015–2016, Mykola Momotenko, former acting head of the State Geocadastre in the Brovary district of the Kyiv region, colluded with Makarenko and Tkachenko to illegally seize state-owned land plots. Makarenko was the director of the Scientific and Production Association Ukrainian Geodesic Service, and Tkachenko headed the Rodzynka garden society.
Together, they used personal information and copies of passports of individual Ukrainian citizens to forge applications in the names of these individuals and other documents, which they subsequently submitted to the Main Department of the State Geocadastre in the Kyiv region. This was done to obtain permission to develop a land management project. Some of those persons had died by that time.
After that, Makarenko and Tkachenko produced land management projects and agreed on technical documentation. Eventually, they registered ownership of land plots in the village of Bohdanivka with a total area of 5 hectares and a value of about UAH 3.7 million.
The court charged Makarenko and Tkachenko with Article 27, part 5 and Article 364, part 2 of the Criminal Code of Ukraine. Both defendants agreed to plea agreements, so the court sentenced them to 5-year suspended sentences with one year of probation, a fine of UAH 17,000, and banned them from holding certain positions for 3 years.
