Case description
On July 10, 2023, the HACC convicted Yurii Davydov, the former head of the Creative Agricultural Holding, who helped former MP Berezkin withdraw a USD 20 million loan provided by Oshchadbank. He got a 5-year suspended sentence on the basis of a plea agreement.
In 2013–2014, Yurii Davydov, chairman of the board of the Creative Agricultural Holding, was an accomplice in a scheme organized by former MP Stanislav Berezkin. The goal was to take possession of a USD 20 million loan from Oschadbank, which was allocated to the agricultural holding. Davydov also helped to legalize the money withdrawn. The Creative Holding was actually controlled by Berezkin and his son.
According to the investigation, the loan funds were withdrawn to foreign accounts of the Swiss company CREATIVE TRADING SA and the offshore company Quadra Commodities SA Limited for the alleged purchase of tropical oil under fictitious contracts.
Subsequently, USD 10 million was transferred to an offshore account in a Latvian bank, and USD 7 million was moved offshore to Cyprus for the purchase of a company that owned Chornomorgidrozalizobeton PJSC. Another USD 3 million of loan funds were transferred to another offshore company. As a result of these actions, USD 20 million was laundered to purchase shares in various companies.
Davydov was charged with Article 27, part 5; Article 191, part 5; Article 209, part 3 of the Criminal Code of Ukraine. Taking into account the plea agreement, the HACC sentenced the accomplice to a 5-year suspended sentence with 3 years of probation, additionally banning Davydov from holding certain positions for 3 years.
According to the agreement, he also undertook to partially reimburse Oschadbank for losses in the amount of UAH 150,000.
